1) Scope

1.1 These General Terms and Conditions (hereinafter referred to as "GTC") apply to all contracts concluded between Sarah Buchholz (hereinafter referred to as "Seller") and the customer (hereinafter referred to as "Customer") regarding the delivery of goods via the Seller’s online store. The Customer's terms and conditions that contradict these GTC are excluded, unless otherwise agreed.

1.2 A "Consumer" within the meaning of these GTC refers to any natural person who concludes a legal transaction for purposes which are outside their commercial or professional activities. An "Entrepreneur" refers to a natural or legal person, or a partnership with legal capacity, acting for commercial or professional purposes when entering into a contract with the Seller.

2) Conclusion of Contract

2.1 The products offered in the Seller’s online shop do not constitute a binding offer but serve as an invitation for the Customer to submit an offer.

2.2 The Customer submits a binding offer by completing the online order form, placing selected items in the shopping cart, and proceeding to the "purchase" button. Once the order is submitted, the Customer’s offer becomes legally binding.

2.3 The Seller may accept the Customer’s offer within five (5) days:

  • By sending an order confirmation by email or fax, which is considered accepted once the Customer receives it.

  • By delivering the ordered goods, in which case the Customer’s receipt of the goods is deemed acceptance.

  • By requesting payment from the Customer after the order has been placed.

The contract is concluded when one of these actions takes place first. If no action occurs within five (5) days, the offer is considered rejected, and the Customer is no longer bound.

2.4 Upon submitting an offer, the contract text is saved by the Seller. After completing the order, the Seller will send the order details and these terms and conditions to the Customer by email or other text form (e.g., fax, letter). The contract text will not be available on the Seller’s website after the order is placed.

2.5 Before completing the order, the Customer can correct any errors by reviewing the information displayed on the screen. Data entered can be modified using the browser’s zoom function or standard keyboard and mouse functions, as long as the Customer has not finalized the order by clicking the "purchase" button.

2.6 The language of the contract is English.

2.7 The order processing and communication typically occur via email, and the Customer must ensure that the email address provided is accurate and that emails from the Seller are not blocked by spam filters.

3) Right of Withdrawal

3.1 Consumers have the right to withdraw from the contract within a statutory period, typically 14 days from receipt of the goods, without providing a reason.

3.2 Additional details about the withdrawal procedure can be found in the Seller’s instructions on the right of withdrawal.

3.3 The right of withdrawal does not apply to Customers outside the EU, where specific withdrawal rights may vary based on the local jurisdiction.

4) Prices and Terms of Payment

4.1 Unless otherwise stated in the product description, the prices listed are inclusive of VAT and other applicable taxes. Shipping costs are calculated separately during checkout.

4.2 For deliveries outside the EU, the Customer is responsible for any customs duties, import taxes, or fees arising from the transaction (e.g., customs clearance fees, exchange rate fees).

4.3 Payment methods available will be listed in the Seller’s online shop.

4.4 Payments made via PayPal are handled through PayPal (Europe) S.à r.l. et cie, S.C.A., subject to PayPal’s terms and conditions, available at PayPal User Agreement.

5) Delivery and Shipping Conditions

5.1 The Seller delivers goods to the address provided by the Customer during the order process, unless otherwise agreed. In case of PayPal payments, the address provided at the PayPal checkout will apply.

5.2 If delivery fails due to the Customer’s fault (e.g., incorrect address or failure to accept delivery), the Customer will bear the return shipping costs. This does not apply if the Customer has exercised their right of withdrawal or if the Seller fails to notify the Customer of the shipping date in advance.

5.3 The Customer cannot collect the goods in person due to logistical constraints.

6) Liability for Defects (Warranty)

6.1 If the delivered goods are defective, the statutory provisions on warranty apply.

6.2 The Customer must report any obvious defects or damage during transport to the delivery company and inform the Seller. Failure to do so does not affect the Customer’s statutory warranty rights.

7) Applicable Law

7.1 The law of the Federal Republic of Germany governs all legal relationships between the Seller and the Customer, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For Consumers, this choice of law is valid only to the extent that it does not exclude mandatory protections provided by the law of the Consumer’s habitual residence.

7.2 This provision does not apply to withdrawal rights for non-EU customers where local consumer protection laws may override the choice of German law.

8) Alternative Dispute Resolution

8.1 The European Commission provides an online platform for dispute resolution at EU ODR Platform, which customers can use to resolve disputes without going to court.

8.2 The Seller is not obliged and does not participate in dispute resolution proceedings before a consumer arbitration board.

Privacy Notice (GDPR Compliance)

For compliance with the General Data Protection Regulation (GDPR), the Seller collects and processes Customer data only for the purpose of fulfilling contracts. Data is handled in accordance with the Seller’s Privacy Policy, which can be found on the Seller’s website.

Additional Notes for International Customers

  • Customs and Duties: For international orders, including deliveries outside the EU, customs duties, taxes, and additional fees may apply. These charges are the responsibility of the Customer and are not included in the product price or shipping costs.

  • Consumer Protection Laws: If your Customers reside in jurisdictions with specific consumer protection laws, ensure your contract allows for the exercise of local consumer rights.

 

Allgemeine Geschäftsbedingungen (AGB)


§ 1 Geltungsbereich und Anbieter

(1) Diese Allgemeinen Geschäftsbedingungen gelten für alle Bestellungen, die Sie in dem Online-Shop auf der Website von Sarah Buchholz (www.sarahbuchholz.com) tätigen.

(2) Unsere Lieferungen, Leistungen und Angebote erfolgen ausschließlich auf Grundlage dieser Allgemeinen Geschäftsbedingungen. Die AGB gelten gegenüber Unternehmen auch für alle künftigen Geschäftsbeziehungen, selbst wenn sie nicht nochmals ausdrücklich vereinbart werden.

(3) Sie können die aktuellen AGB auf unserer Website einsehen und ausdrucken.

§ 2 Vertragsschluss

(1) Die Warenpräsentation im Online-Shop stellt kein verbindliches Angebot auf den Abschluss eines Kaufvertrages dar, sondern eine unverbindliche Aufforderung zur Bestellung.

(2) Mit Anklicken des Buttons „Jetzt zahlungspflichtig bestellen“ geben Sie ein verbindliches Kaufangebot ab (§ 145 BGB).

(3) Der Kaufvertrag kommt erst zustande, wenn wir Ihre Bestellung ausdrücklich annehmen oder die Ware an Sie versenden.

§ 3 Preise und Versandkosten

(1) Die auf den Produktseiten angegebenen Preise enthalten die gesetzliche Mehrwertsteuer und sonstige Preisbestandteile, sofern nicht anders angegeben.

(2) Die Versandkosten werden im Bestellprozess gesondert ausgewiesen.

§ 4 Lieferung und Eigentumsvorbehalt

(1) Die Lieferung erfolgt an die von Ihnen angegebene Adresse.

(2) Die Ware bleibt bis zur vollständigen Zahlung unser Eigentum.

§ 5 Widerrufsbelehrung

Widerrufsrecht Sie haben das Recht, binnen 14 Tagen ohne Angabe von Gründen diesen Vertrag zu widerrufen. Die Frist beginnt ab dem Tag, an dem Sie oder ein von Ihnen benannter Dritter (der nicht der Beförderer ist) die Ware erhalten haben.

Um Ihr Widerrufsrecht auszuüben, müssen Sie uns (E-Mail: sarahbuchholz@posteo.de, Website: www.sarahbuchholz.com) mittels einer eindeutigen Erklärung über Ihren Entschluss, diesen Vertrag zu widerrufen, informieren. Zur Wahrung der Frist reicht es aus, dass Sie die Mitteilung vor Ablauf der 14 Tage absenden.

Folgen des Widerrufs Wenn Sie diesen Vertrag widerrufen, erstatten wir Ihnen alle Zahlungen (exklusive Lieferkosten) innerhalb von 14 Tagen nach Erhalt der Rücksendung. Die Rückzahlung erfolgt mit demselben Zahlungsmittel, das Sie bei der ursprünglichen Transaktion eingesetzt haben.

Wir können die Rückzahlung verweigern, bis wir die Waren zurückerhalten haben. Sie müssen die Waren unverzüglich und spätestens innerhalb von 14 Tagen nach Widerruf an uns zurücksenden. Die Frist ist gewahrt, wenn Sie die Waren vor Ablauf der Frist absenden.

Sie tragen die Kosten der Rücksendung. Für einen Wertverlust müssen Sie nur aufkommen, wenn dieser auf einen Umgang zurückzuführen ist, der zur Prüfung der Beschaffenheit, Eigenschaften und Funktionsweise der Waren nicht notwendig war.

Ausnahmen vom Widerrufsrecht Das Widerrufsrecht besteht nicht bei Waren, die speziell für Sie angefertigt wurden (z. B. Auftragsarbeiten).

§ 6 Transportschäden

(1) Werden Waren mit offensichtlichen Transportschäden angeliefert, reklamieren Sie diese bitte direkt beim Zusteller und setzen sich schnellstmöglich mit uns in Verbindung.

(2) Die Versäumung einer Reklamation hat keine Auswirkungen auf Ihre gesetzlichen Gewährleistungsrechte. Sie hilft uns jedoch, unsere Ansprüche gegenüber dem Transportdienstleister geltend zu machen.

§ 7 Gewährleistung

(1) Ihre Gewährleistungsrechte richten sich nach den gesetzlichen Bestimmungen.

(2) Für Unternehmer gelten die gesetzlichen Bestimmungen mit folgenden Modifikationen:

  • Offensichtliche Mängel sind innerhalb von 7 Tagen nach Erhalt der Ware schriftlich anzuzeigen.

  • Wir leisten Gewähr durch Nachbesserung oder Ersatzlieferung.

  • Schlägt die Nacherfüllung zweimal fehl, können Sie Minderung verlangen oder vom Vertrag zurücktreten.

  • Die Gewährleistungsfrist beträgt ein Jahr ab Lieferung.

§ 8 Haftung

(1) Wir haften uneingeschränkt für Vorsatz, grobe Fahrlässigkeit sowie für Schäden an Leben, Körper und Gesundheit.

(2) Bei leichter Fahrlässigkeit haften wir nur für wesentliche Vertragspflichten (Kardinalpflichten) und nur für vorhersehbare Schäden.

§ 9 Schlussbestimmungen

(1) Sollten einzelne Bestimmungen dieser AGB unwirksam sein, bleibt die Wirksamkeit der übrigen Bestimmungen unberührt.

(2) Es gilt ausschließlich deutsches Recht.

(3) Für Kaufleute, juristische Personen des öffentlichen Rechts oder öffentlich-rechtliche Sondervermögen ist Gerichtsstand Berlin.
